Types of injuries associated with motorcycle accidents

Case Study: Matthew’s claim – Injuries in motorcycle accident

Matthew was involved in a motorcycle accident. He was approaching a crossroads where he had the right of way to carry through when a van pulled out in front of him and Matthew sustained significant injuries as a result of the accident. Matthew sustained injuries to his back and spine which required a number of surgical procedures and a lengthy stay in hospital. He fully recovered from those injuries after a period of nine months.

Matthew took a compensation claim for the physical injuries sustained, the psychological injuries sustained which was primarily post-traumatic stress and a claim for loss of earnings as he worked as a Courier. Matthew’s claim was initially brought to the Injuries Board who issued a certificate of authorisation to take Court proceedings.

We took proceedings before the High Court on Matthew’s behalf approximately two years after the accident and his case settled prior to the hearing date that we had obtained for Court. Matthew received compensation in the sum of €263,000 in addition to the special damages which he was entitled to in order to cover his loss of earnings and out of pocket expenditure. In addition to the compensation and special damages achieved, we also recovered Matthew’s legal costs in full from the Defendant’s insurance company.
