What to do when you have a taxi accident

If you have been involved in an accident during the course of your taxi journey it is crucial that you obtain the following information:

  • Details of the taxi driver to include his or her name and address
  • Details of any other drivers responsible for the accident
  • Get the taxi registration number and the car registration number and insurance details of the taxi driver for the vehicle
  • Obtain the name and address, vehicle details and insurance details for any other vehicles which were party to the accident
  • If there are any witnesses to the accident you should obtain the name, address and contact details of any witnesses
  • You should seek medical attention as soon as possible after the accident in order that a detailed assessment of your injuries can be recorded
  • You should speak to your Solicitor with a view to instructing your Solicitor to lodge a claim to the Injuries Board on your behalf

Case Study: John’s claim – Whiplash injury in taxi accident

John was travelling in a taxi as a passenger when the taxi that he was travelling in was rear ended by a vehicle travelling behind the taxi. John sustained a very significant whiplash injury and superficial bruising as a result of the taxi accident.

We took a claim to the Injuries Board on John’s behalf and we named the taxi driver and the driver of the vehicle that rear ended the taxi as the Defendant’s. We later excluded the taxi driver as a defendant and took the claim specifically against the driver of the vehicle that rear ended the taxi. It became necessary to initiate proceedings before the Circuit Court in relation to John’s injuries which we duly did.

John’s case was set down for hearing but on the morning of the hearing, we managed to negotiate a very favourable settlement on John’s behalf. John’s case settled for the sum of €35,000 to include his loss of earnings and special damages. As part of the settlement we recovered all of the legal costs associated with John’s case from the Defendant’s insurers.
