  • Gather evidence as soon as possible after the accident takes place.  If you have been injured by a hazard within the shopping centre be it a wet floor or other hazard, photographs should be taken of the hazard as soon as possible.
  • You should gather details of any witnesses to the accident or persons that may have helped you in the immediate aftermath of the accident.

Case Study: Louise’s case – accident in shopping centre – compensation claim

Louise was in a department store in a shopping centre and she was entering the elevator to go to the next floor.  As she entered the elevator the door of the elevator suddenly jerked to one side hitting her on her way in to the elevator.

Louise was thrown to the floor of the elevator and assisted by the other patrons within the elevator.  As a result of the accident, she broke her collarbone and she sustained bruising and stiffness around her shoulder and collarbone area.
